Child-Resistant Packaging Requirements by State (2026)

Federal CR Standards
At the federal level, child-resistant packaging is governed by the Poison Prevention Packaging Act (PPPA) and enforced by the CPSC under 16 CFR 1700.20. The testing protocol requires that:
- 85% of children ages 42-51 months cannot open the package within 5 minutes
- 90% of adults ages 50-70 can open and re-close the package within 5 minutes
- Testing must follow the sequential paired-testing protocol with 200 children and 100 adults

Types of CR Mechanisms
There are four primary child-resistant closure mechanisms used in mylar bag packaging:
- Pinch-N-Slide: Simultaneous pinching and sliding to open. Most widely accepted mechanism for cannabis. Meets both ASTM D3475 and 16 CFR 1700.20.
- Press-To-Close Button: Snap-button requiring coordinated force. Popular for flower bags and edibles. Highly durable for repeated use.
- Push-Turn Zipper: Two-step opening with maximum child resistance. Best for pharmaceutical applications.
- Tear-Away + CR: Tamper-evident first-open seal with CR zipper underneath. Provides dual compliance in one package.
Beyond Cannabis: Other Products Requiring CR Packaging
The CPSC mandates child-resistant packaging for numerous product categories beyond cannabis: prescription and OTC medications, household chemicals and cleaning products, nicotine e-liquids (PACT Act), pesticides and drain cleaners, certain cosmetics and nail products, and fuel-containing products.
How to Ensure Compliance
According to Cubit Packaging compliance specialists, ensuring your packaging meets CR requirements involves: using ASTM D3475-certified bag suppliers (certificates should be provided), reviewing state-specific labeling requirements before design approval, maintaining compliance documentation for regulatory audits, and consulting with packaging experts when entering new state markets.
